A MAN has denied raping a drunken young woman while she slept.

Andrew Mark Phillips, 32, is facing trial at Dorchester Crown Court over allegations that he raped a woman he had met at the George pub in Charmouth in the early hours of January 2.

The court heard that Phillips, of Beavers Road, Farhham, Surry, had come down to visit friends for New Year’s Eve and had decided to stay on the extra night.

In a recorded police interview played to the jury, the alleged victim said she had been drinking on the night of January 1, but she was not out of control.

She said: “I was drunk but I didn’t drink an excessive amount.”

She said Phillips accompanied her on the walk to her friend’s flat where she was staying after the pub had closed and they went in and watched television on the sofa.

The woman admitted she had kissed Phillips, but after ‘five to 10 seconds’ she had pushed him away and told him to stop.

She said she later fell asleep on the sofa and woke to find Phillips raping her.

She said: “I stood up and pushed him back, I remember pushing him away and saying ‘I said no’ and then I just ran to the door.”

The alleged victim said it was never her intention to sleep with Phillips.

She told the interviewing officer: “I know 100 per cent there was no consent.”

Carolyn Branford-Wood, prosecuting, earlier told the court that Phillips was arrested later that night and in interview admitted there had been sexual activity between the two of them.

He told officers they had sexual intercourse twice and that it had been consensual.

Miss Branford-Wood said: “What he was particularly clear about was she never fell asleep and never indicated she was not a willing participant.”

The case continues.
