A WEYMOUTH woman has been given a chance to avoid a jail term for three offences including fraud by false representation.
Kellie Marie Cutler, 33, of Douglas Road, was sentenced to 56 days in prison at Weymouth Magistrates Court in January for the fraud offence and breaching both a community order and a suspended sentence order. However, she was then bailed pending appeal and appeared at Dorchester Crown Court to contest the sentence.
Prosecutor Edward Elton told the court that the fraud by false representation offence related to an incident at Asda in Weymouth on September 20. He said Cutler took a duvet worth £20 off the shelf and then took it to the customer service desk where she claimed she had bought it and wanted a refund.
At the appeal hearing sentence was deferred for four months, with Cutler told she must stay out of trouble and continue to make improvements in her personal life. She will return to court on September 9.
Judge Roger Jarvis said: “If you continue to do well you probably won’t go into custody. But if you do badly I’m afraid we are going to look very carefully at the prison sentence that was imposed.”
