A man who breached an order by spitting at a police officer and being drunk and aggressive in Weymouth town centre has been jailed.

Lee Dolbear, 51, appeared at Weymouth Magistrates Court where he pleaded guilty to assault by beating of an emergency worker, failing to comply with a section 35 dispersal order, failing to comply with a community protection notice and using threatening/abusive/insulting words/behaviour.

It refers to an incident which happened from midday onwards on September 27, 2024.

Elizabeth Valera, prosecuting, said Dolbear entered Tesco in the town centre which he was banned from entering. He was described as being "clearly drunk" and told to leave.

Dolbear was described as "aggressive" and shouted at staff.

A community ranger came to help and told Dolbear to leave.

Magistrates heard the defendant began to leave but when followed by the ranger he put up his fist and said: "Stop following me or I'll chin you."

Police were called and Dolbear was issued with a section 35 dispersal notice, ordering him to leave the area for 12 hours. But he returned to the town centre and was arrested. 

The court heard Dolbear threatened the arresting officer saying he was going to kill him. In a statement, the officer said he felt the threats were "legitimate".  

Once in a police vehicle Dolbear continued to shout through a crack in the door and spat in the officer's face. 

By committing these offences, Dolbear breached a suspended sentence imposed in January.

He has previous convictions for drunk and disorderly behaviour, assaulting an emergency worker and using threatening words/behaviour.

Patricia Sheehan, mitigating, said: "Mr Dolbear had no previous convictions until 2021. This points out that something has gone very wrong.

"He was somebody of good character and he says he wants to be the person he used to be."

She added that Dolbear had been caring for his father and his death in 2023 sent him into turmoil and a deep cycle of grief.

Dolbear, of Ranelagh Road, Weymouth, receives Personal Independence Payments payments due to his mental health problems.

He was given a one month prison sentence for failing to comply with a section 35 dispersal, six weeks for assaulting an emergency worker, and one month for using threatening words. The sentences are to run concurrently, which means he will spend one month in custody.

He received no separate penalty for failing to comply with a community protection order.

Dolbear was ordered to pay £100 in compensation to the community ranger and £150 to the arresting officer.

He must pay costs of £85 and a surcharge of £154.
