The West Dorset District Council

(Off-Street Parking Places) (Consolidation) Order 2016

Notice is hereby given that West Dorset District Council (hereinafter referred to as "the Council") has made an Order in exercise of its powers under Sections 32, 35, 35A, B and C and Parts III and IV of Schedule 9 of the Road Traffic Regulation Act 1984 ("the Act of 1984"), the relevant powers under Part 6 of the Traffic Management Act 2004 ("TMA 2004") and of all other enabling powers, in accordance with Regulation 21 of the Local Authorities' Traffic Orders (Procedures) (England and Wales) Regulations 1996 and after consultation with the Chief Constable of the Dorset Police and with the consent of the County Council of Dorset in accordance with Section 39(3) of the Act of 1984.

The effect of the Order will be;
1. To revoke the Orders specified in the Schedule below.

2. To re-enact the provisions of those Orders (and of all amendments subsequently made to those Orders) without any changes of substance having been made, other than those necessary to;

a) Reflect the Council's commencement of Civil Parking Enforcement (under the provisions of the TMA 2004) on the off-street car parks which it operates, and

b) Update the provisions concerning the methods by which the charges for the use of Parking Places may be made, to reflect the various payment options which are now available.

This Order has been made for the purpose of introducing the above changes, to confirm and clarify the existing rules and regulations pertaining to the use of the Councils off-street Parking Placesand tobring all ofthe Council'sOrdersrelating to those Parking Places together into a single document. It does not amend any of the pay and display/pay by phone parking charges which currently apply to the use of its car parks.

The Order will operate from 13th June 2016. A copy of the Order may be inspected during normal office hours at South Walks House, South Walks Road, Dorchester DT1 1UZ.

If anyone wishes to question the validity of the Order, or any provision contained within it on the grounds that it is not within the powers conferred by the Road Traffic Regulation Act 1984, or on the grounds that any requirement of that Act or of any Instrument made under it has not been complied with in relation to the Order, they may within six weeks of the date on which the Order was made (2nd June 2016) apply to the High Court for the purpose.
